Citizenship and the Census… the Controversy Is Coming to a Head
Should the 2020 U.S. Census include a question asking whether the person responding is a U.S. citizen? That’s the question that has caused intense debate in Washington lately that may have a huge impact on the next 10-year census.
Between 1820 and 1950, that question was on every census form. However, it has only been on a small percentage of census forms since 1960.
But the fact of the matter is each question on the census impacts a wide variety of areas. It determines how many seats in the U.S. House each state has, as well as almost every corner of American life. From business, education and polling, to name a few.
This is why adding or subtracting survey questions can be highly controversial. But before I ask you to answer the question yourself, let me give you a bit of history.
Two Opposing Viewpoints
Secretary of Commerce Wilbur Ross wants the question added to the 2020 census form.
He says the Justice Department wants that question included. That’s so the Voting Rights Act of 1965 can be better enforced to avoid minority discrimination in elections.
Democrats say that’s a sham. They believe this Donald Trump appointee wants the question added to keep non-citizens from being counted in the census. They argue that the U.S. Constitution requires the counting of all people residing in the country. Not just citizens.
The theory is that many undocumented residents will refuse to fill out their census forms. Because they don’t want to raise a red flag by telling the government they are undocumented.
Divided Along Party Lines
Why is this timely? The census is a year away, right? Yes, but census forms will be printed in July. So, the Supreme Court must make a decision on this issue by the end of June.
So far, 18 states have challenged the addition of the question. Plus 16 municipalities and the U.S. Conference of Mayors.
If non-U.S. citizens are not counted in the 2020 census, some states will lose billions in federal funding. They will also lose seats in the U.S. House of Representatives.
States with the highest percentage of non-citizens tend to vote Democratic. States with the lowest percentage of non-citizens tend to vote Republican. Of course, there are some exceptions.
District Judges Weigh In
Judges in various parts of the country are critical of the Trump administration’s attempts to add the question to the census form.
George Hazel is a U.S. district judge in Maryland. He called the attempt “woefully deficient.”
Richard Seeborg is a U.S. district judge in California. He called efforts to justify it a “cynical search.”
Jesse Furman is a U.S. district judge in New York. He said, “They are the acts and statements of officials with something to hide.”
All three of those states voted for Hillary Clinton over Trump in the 2016 presidential election.
Media Against the Question
Some interesting reactions to this controversy come from the editorial board of the Cleveland Plain Dealer newspaper.
Lisa Garvin calls the citizenship question “a modern-day scarlet letter.” Victor Ruiz refers to it as “an onslaught on people.”
Thomas Suddes wrote, “Congressional districts are based on the number of residents, not the number of citizens. Hold down the non-citizen count in a given (hint: Democratic) state, and that state gets shortchanged in the U.S. House.”
Eric Foster writes, “The citizenship question causes more harm than good. Due to the fact that there is zero good that can come of it.”
Media in Favor of the Question
But other board members disagree. Ted Diadiun writes, “Of course we should ask the question. Only those who are trying to help illegals hide in plain sight would have any reason to oppose this.
“If illegal immigrants refuse to participate, thereby lowering the ‘official’ population of sanctuary states like California… oh, well.”
Mary Cay Coherty concurs. “Ask the citizenship question,” she wrote. “This data, like racial demographics, is important. The question poses no threat.
“Seventy-five percent of our 44 million immigrants are here legally. And census data cannot be used against the 11 million illegal immigrants. Why the worry?”

I feel the question needs to be asked. I am an independent voter and decided this was necessary long ago due to was what I was seeing as two parties in a political dramatic power struggle. Two different views. Neither seems to collectively govern. Meanwhile the country’s problems remain and the debt just goes out of control. A continual cycle of crime, greed, disrespect, bias, abuse, favorites, lies and prejudice. This cycle needs to stop and those who genuinely want to be citizens and contribute to the overall welfare of this country should be granted a path to citizenship which includes qualification for a work permit or green card. Those who want live a life of one crime upon crime and a motive of take should leave through force of the US Government. They should not be allowed to return. As for those who wish to pursue a college, university or seminary education that honestly earns a degree they need bonafide proof of support that can be shown to Immigration and throughly checked out before allowed here. After they have completed their education, they must return to their home country. I say they should know the English language before using our post secondary education system also as a requirement and take the test showing they know English without a doubt. There should be no exceptions. If they want to stay they should know English BEFORE allowed a path to citizenship after they complete their post education, learn our country’s COMPLETE history, Constitution and given a polygraph as to their intent. If found not to have true intent, they should be deported immediately and not allowed to return. All of them should obey ALL State and US Laws. By all means the question should be asked without bias or exception.

A strict originalist interpretation of the Constitution indicates that we must count ALL persons present in the United States, and not just citizens. Considering the political climate, this question is designed to discourage non-citizens from completing the Census, out of fear of adverse legal action. Having worked for the Census the last two times around, I am opposed to the question being included.

I don’t know for sure which is why we need this question answered on the census but I suspect that the states that support illegals over US citizens are losing citizens and therefore should be losing the number of house representatives and electoral college votes. for the sake of statistics I think the question should be there. Having that said, the results or findings should express both realities,
I am not a US citizen or resident, I am a world citizen, a human being that has visited the USA but chose to live somewhere else. So I will not even be answering any of the questions!
The matter is: what are statistics? For that answer I’m afraid to say that the best politician to define the concept was Stalin. Yes, that Stalin, he said: “it’s not the votes that count, it’s who count the votes.”
So again, for statistics sake, include the question and make them both findings public – the results for residents and citizens. Then one can work on the issues at hand for the greater good, hopefully.

As a citizen I am for asking this question & as a genealogist it has really helped with research. However, not all non-citizens are here illegally! Many are here on H1B visas to work. Some were brought by their parents a whole generation ago as babies & have lived and worked here all their lives, married and had children here . Maybe their parents never told them they were illegal. Some are here on TPS & have also met & married US citizens. They are non-citizens but not illegal. Just throwing out some food for thought.

The United States is a Republic based on our Constitution & Constitutional Laws. Voting is based on each U.S. Citizens “Right of Representation”. The “Right” is NOT given to citizens of foreign countries.
States Representstives MUST be based on how many citizens there are in the State — NOT on how people “reside” in the State.
How the States allocate funding for schools, hospitals, social services is based on the CENSUS counting ALL residents of the State – citizens AND foreign residents. But the States NEED to know the composition of their populations.

Yes, it should be added. You need a total headcount and you need a total legal voting count. Why should undocumented illegals be permitted to vote to change the way of our lives? They are here enjoying what we fought and died for. An accurate census is also vital for good planning, and the question of citizenship definitely needs to be included in it. Having an accurate count and family content is so very vital in doing family research and tracing your family’s history. Asking this question is so much more important than just for political and legal purposes. Tracing your family history and knowing where they came from and why is important also.

Our forefathers went through Ellis Island or another and followed the path to citizenship. This is what I wrote Pres. Trump and my Congress people in early 2018:
I have thought long and hard about the children of illegal parents in this country. Even though I feel for their plight, the bottom line is they are still illegal.
Listen, I am native born. For nine years, my work career took me legally to a foreign country, where I remained legal in everything.
When the time arrived to move back to this country, the U.S. customs would not allow me back because I had acquired the other countries citizenship, (so I could vote there) knowing that I did not have to renounce my U.S. citizenship. That is not how Customs saw it. Eventually, taking a whole year, a U.S. court ruled on this situation of several of us in the same predicament, ruling in our favor.
My point, if a legal, clean U.S. citizen has to abide by all this, then why should every illegal person in this country not have to abide by the proper immigration laws?
Every illegal person in the U.S. needs to go through the legal immigration process if they truly want to remain, live and/or work in the U.S., let alone to receive its social welfare benefits.

Two things that I am anxious to support is E Verify, and instant deportation. Instant deportation is legal if the violators are returned to the country that they crossed from. They are also breaking the laws of Mexico which is another reason to return them.

Yes, the citizenship question must be added back on the 2020 Federal Census, and kept on all of them in the future! are just a few items that may/do require a person to be a citizen. If someone wants to live in this country, they should be able to pass a background check, a citizenship class & as part of that requirement maybe even serve in military or do some community service as part of their admission & be able to speak English @ a high school level or better. Include the question. Montana is the fourth largest State in area, but with the small population only has one member of Congress. Excluding illegals could give it two. At 1.25 million or so, Montana has the largest population per district. With 147,042 square miles it is smaller, big time, than Alaska, but Alaska has 750,000 people and Montana has more than a million, making it the largest populated Congressional district in America. Adding the question could give Montana two members of Congress. Not added it could keep them with one until at least 2030.

This is a very sore subject with me. I live in the border state of Arizona and have seen the illegals come into our Hospitals and given free care paid by my State. The question should be certainly added. This is nothing new as any genealogist can tell you. It only makes sense for a people to be able to know who is in the country especially true since we are expected to care for them in ways we should not.

I am curious as to why the question was dropped from the Census Forms. And did it happen nationwide or somehow gradually? Was it a politically motivated change? Was it for shifting funding? Also, do District of Columbia (Washington, DC) and Puerto Rico residents participate in the census process? I know there are many efforts to “capture” complete and accurate counts even when people do not have permanent addresses and might move during the counts. All of the details seem important and whether all or just some of the household members are US citizens seems to me to be a valid question.

Yes, absolutely ask the question. That won’t guarantee honest answers. But questions like name? Address? Phone #? etc. don’t necessarily get honest answers. There is no valid reason for this question on a census questionnaire. The purpose of the census is to count the number of residents in an area, nothing to do with citizenship. Furthermore, no one seems to be aware of the tens of thousands of LEGAL immigrants currently living here – in EVERY state – with student visas, professional work visas, or waiting – I think it’s 5 years – to be able to apply for citizenship after obtaining a green card. These are legal permanent residents – most of whom would find it humiliating and even threatening to be questioned about their citizenship in the current anti-immigrant climate when they have done everything right and want nothing more than that citizenship they aspire to. In addition, there are those forgotten DACA holders! Thousands of amazing young people who had the misfortune to have been brought here when they were babies by undocumented parents. I am a retired immigration paralegal. I got to know many of them. They really are Dreamers in the truest sense of the American Dream, and have already contributed a tremendous amount to our country as students and teachers and professionals. Imagine going through elementary and middle school and high school and college and graduate school feeling like an American yet never knowing if you are going to be deported any day because of the actions of your parents. I think the question should be: Are you a legal resident vs. citizen? Legal immigrants have no restrictions except that they cannot vote whereas citizens are registered voters. As a legal immigrant, I was allowed to join the military and fight to protect our freedom. I did not become a U.S citizen until 5 years later. My action to put my life on hold is a testimony of my love and devotion to this country. There are thousands of legal immigrants serving in the military even though they are not yet citizens. Should they be counted in the census?

I am a citizen of the United States because I was born here. My wife is a naturalized citizen after doing all that is required to come here legally and then becoming a citizen. She came here from Holland just after the end of WWII and the Nazi occupation. She had to learn to speak, read and write English. She also had to take the classes and pass the tests to become a citizen. We very much object to having illegal immigrants posing as legal when they are not. We live in a neighborhood with many illegals and legals but they should not be allowed to vote. We both worked on the local election board for many years. But in later years we were not allowed to ask if they were citizens. Particularly those who could not speak English.

I do genealogy and yes, the citizenship question is important. A “C” means native born, “N” means naturalized, and an “A” means alien or foreign native. “P” for pending citizenship? The citizenship questions is very important. So is requiring a valid citizen ID for voting purposes. Nearly everyone has a valid form of ID. It is required to purchase alcohol and cigarettes. It should most definitely be required for voting.

I would ask the question, but know that there is no guarantee any respondent will answer truthfully. The bulk probably will, and the final numbers will be close to the truth. And having a reasonably accurate number is better than have no answer at all.
It will have no impact, though, on voting or assignment of house of representative districts. Those assignments are based on overall numbers, and NOT based on counted citizens.
Prevention/elimination of voter fraud will require a Citizenship ID, and the US is loathe to reach a point where people will be issued “papers” and must show these papers to perform certain rights guaranteed by the constitution.

Yes, ask the question on citizenship. It will let us know how many non citizens there are in the country and where they are at. It will also bring the need for an over update of all laws on immigration to a priority point for all. Everyone will benefit in the long run. Some non citizens will choose to enter a”work permit program” where employers will have to pay the work permit immigrants a fair wage and withhold for federal & state taxes and for medicare. But no work permit immigrants should be hired by an employer as a cheaper replacement employee while a willing an able US citizen could and would do the job. Other immigrants will chose to apply for citizenship, while others may just decide their free load and hide away cover is over and go back to their home country. It is all about what is good for the USA and every immigrant that has good character and intentions will have a choice to work and stay or to become a citizen following the traditional process.

Citizenship has its benefits and its requirements. Words are not sufficient. Actions must be a part of this declaration. Earning such a status bestowed without cost sets us up for being infiltrated by those who have evil intention against our eternal existence. I believe the question of citizenship should be on the census. It is, after all a US census, should we know how many US citizens there are? This question has nothing to do with elections or voting, it has to do with counting citizens.

My family lived in England but records indicate they were visiting family in Ireland during the census. They were counted as non- citizens with England being their home country. Since the children were still in England they were not counted at all. Very simple. You are either a citizen or you’re not, if not where are you from.

I think YES add the question but, also ask 1-If you are not a citizen what country are you a citizen of? 2- are you just visiting? from where? 3- are you here legally? 4- what country were you born in.? That way the government would know how many citizens are in a state, how many are just here visiting and what is their home country. How many are here legally and how many are not. Total them all together to find out the total population at the time of the census.

It is and should be important in many other ways. From a genealogy viewpoint it is important. Also if the founding fathers thought it was important and it was in the census for many years before being dropped, I feel it is right to have it in the census.

YES add the question: It should never have been removed. I’ll be glad when the border wall is complete, it will not stop all the problems but it sure will get most of them. To have all applicants for citizenship / temporary visa’s channeled through the proper stations will help solve a lot of problems. If the founding fathers saw a reason for asking the question important enough to add it to the Constitution so that there is an accurate count of the number of people who are living in the USA then it should be asked!! We definitely need to know important information like this for a number of reasons not. Not to use it to deport people but to know how many people are living here to keep track of how money is used and also in voting. The Constitution is clear on who has the right to vote in elections and if someone took the time and entered into the Country and took the time to become a citizen then they shouldn’t be punished for there hard work and effort by allowing A non-citizen illegal alien to be afforded the same rights is not fair nor just!
I, for one, believe Ben hit it right on the head. Way back, my dad entered this country – became a citizen – and also fought for this country during WWII. When my turn came, I GLADLY joined the Nuclear, Ballistic Missile, Submarine Force and served 20 years supporting and defending the US. Even during Khruschev’s rant and ravings at the UN when he was pounding his shoe on the dais, even during the Bay of Pigs fiasco, even during the blockade of soviet missiles trying to be installed in Cuba – right off our shores during President Kennedy’s tenure (thank you JFK). My submarine had put to sea from Norfolk during this blockade – Norfolk became a “Ghost Town”. So, NO – I don’t want illegals voting in my country. If they want to try and vote – let them go back to their own country and “try” to vote !!!!!!!!!

There are multiple cases discovered every national election where non-citizens were found to not only have voted, but to have been encouraged to vote by poll workers (democrats by the way, according to sting operations). Those found indicate many more who are not found. They are here illegally, why care about voting illegally… or following any law that inconveniences them for that matter (granted many exceptions, but if you start off illegally, you likely have little respect for laws to begin with).
